Trademark Selection - How Do You Choose a Trademark?

Created and minted trademarks

  • The term "invented" or "coined marks" refers to the creation of a new term that is not included in a dictionary and does not match any already-registered or applied trademark, like "Samsung" or "Adidas."
  • Because they are powerful, these are also the easiest to defend against.

Arbitrary marks

  • Marks that are commonly used but have no obvious connection to the products or services they are used for, such as "Blackberry" for phones, "Apple" for computers, and "Kangaroo" for stationery, are known as arbitrary marks.
  • It is relatively simple to register and defend these marks as trademarks.

Marks that are suggestive and descriptive

  • Marks that describe a product's attribute are known as descriptive marks. For example, "Fair" is used to indicate fairness in cosmetics, while "Print Media" is used to indicate newspaper publications.
  • Marks that imply a feature of the product—such as "Habitat" for home furnishings or "Airbus" for airplanes—are known as suggestive marks.
  • These are thought to be relatively difficult to register as trademarks and protect.

Well-known brands

  • The applicant should make sure that, when adopting any mark, it isn't being utilized by anybody else in India or outside, particularly if that mark is well-known.
  • The notion of a “renowned trademark” and the idea of “trans-border reputation” is accepted in India.
  • Well-known brands include Microsoft, Pepsi, Google, Tata, Yahoo, and so on.

Marks are generic

  • Using the product name for the product is known as generic marking. Examples of this are furniture brands like Wood and packaged water brands like Jal.
  • It is most difficult to secure these marks as trademarks.

Several trademark symbol types

  • TM symbol (™). The trademark may be utilized in conjunction with it as long as the application is still pending and the trademark is not yet registered. It is mostly used to tell the audience about the brand's exclusive claim.
  • The SM Symbol. For Service Mark, use SM. Regarding trademark applications submitted for services, it is utilized. It's a service mark, for instance, if the applicant filed for a registered trademark in connection with IT services.
  • The R symbol is ®. Once the trademark is registered and the Registrar of Trademarks issues a certificate of registration, the applicant may use the R sign. The circled R cannot be used until you have received your registration.
  • The symbol for C is ©. The letter C represents copyright. It safeguards the original creative works of writers, including computer software, sound recordings, dramatic works, pantomimes, dance, literary works, musical works, and artistic and architectural creations. The name of the copyright holder and the year of initial publication are used with the C sign. In India, it is not required to use the C symbol. Nonetheless, in several countries, using this mark is required to assert copyright protection.
