In order to import pre-packaged goods into India, importers must get the Legal Metrology Registration Certification, in addition to LMPC. Customs may take the products if they are not registered. The packaging criteria for the sale or distribution of pre-packaged commodities in India are regulated by the Legal Metrology Certification (LMPC) program.

Food, medicine, and other things may all have specific regulations outlined in their governing legislation. For example, pharmaceutical products must adhere to extra guidelines set down by the 1940 Drugs & Cosmetics Act. In order to distribute or sell pre-packaged goods, importers must apply for import registration through legal metrology. The LMPC registration is known by several names, including "Legal Metrology Certificate," "Importer Registration under Legal Metrology," and "Importer Registration under Rule 27."

What exactly are prepackaged goods?

Pre-packaged goods are defined by the Act as "goods that, in the absence of the buyer, are placed in a package of any kind, whether sealed or not, to ensure the product contained there has a pre-determined quantity." Pre-packaged items include things like wool, paint, chemicals, infant food, food products, fuel, and cement in bags.

The significance of metrology in law

Measurement analysis is known as metrology. Legal metrology pertains to the weight and measuring units and techniques in accordance with necessary legal and technical standards. That's how legal metrology is officially defined. However, how precisely does it apply to pre-packaged goods?

We purchase products from the market that are either loose or already packaged. Weighing is done in front of us for the loose commodities (fruits, vegetables, grains, and flour). We are able to assess their quality directly. Nevertheless, we are unable to verify the product's safety, freshness, or weight when we purchase it already packaged. We also don't know who made it. The Legal Metrology Act provides the buyer with the necessary data (weight, quantity, price, expiration date, etc.) to enable them to make an informed purchase.

For importers, what does an LMPC certificate mean?

It is required of traders that import pre-packaged products for sale or distribution to apply for their name and address to be registered with the the Controller for Legal Metrology in their state or by the Director of Legal Metrology at the federal government. The Director/Controller of Legal Metrology, who is the registering authority, will register the importer's name and address and issue them with an LMPC certificate if the application is approved. This is the appearance of an LMPC certificate. A one-year minimum and a five-year maximum are associated with an LMPC registration.

To sell pre-packaged goods within a single state, one has to submit an application to the controller of that state. Should you intend to offer your products in more than one state, you will have to register with the Center's director via your local controller.
