Understanding EPR Registration for Plastic Waste Management

Extended Producer Responsibility (EPR) applies to any organisation that introduces plastic packaging to the consumer market. According to the Plastic Waste Amendment Rules 2022, the Ministry of Environment, Forestry and Climate Change (MoEF&CC) outlines the procedures for obtaining EPR Certificates for Plastic. The Central Pollution Control Board (CPCB) grants EPR Authorizations to producers, importers, brand owners (PIBOs), and plastic waste processors for recycling and other activities such as waste-to-energy, waste-to-oil, and industrial composting.

The Importance of EPR Certificate for Plastic Waste Management

All organisations that produce pre- and post-consumer plastic packaging waste must comply with EPR Authorization. Registering with the CPCB and SPCB is mandatory, and PIBOs operating in more than two states or UTs must register with the CPCB. The EPR Certificate for Plastic is crucial for commencing manufacturing and ensures that plastic waste is managed in an ecologically responsible manner.

Key Requirements for EPR Registration

  1. Submit Form I: Organisations must submit Form I and an Action Plan suitable under the Environmental Protection Act, 1986.
  2. Compliance with PWM Rules: Fulfill all prerequisites as outlined in the Plastic Waste Management (PWM) (Amendment) Rules, 2022.

  3. Brand Owners (BO) (excluding micro and small businesses)
  4. Processors of Plastic Waste involved in:

Banned Plastic Products in india

The following plastic items are banned:

  1. Stirrers, plates, cups, glasses, cutlery, straws, trays
  2. Plastic wraps or packaging around candy boxes
  3. Earbuds adorned with plastic sticks, such as balloons, ice cream sticks, candy sticks, and plastic flags
  4. Polystyrene (Thermocol) decorations

Effective December 31, 2022, the Plastic Waste Management Amendment Rules 2021 also prohibit plastic carry bags with thicknesses less than 75 microns and 100 microns.

EPR Authorization Renewal and Cancellation

EPR Registration granted under the PWM Rules, 2016 (as amended) does not require renewal unless requested by the Producers, Importers & Brand Owners. However, registrations can be cancelled if fraudulent documentation is provided.

EPR Registration

If your plastic product is subject to EPR, the final step is to register online using the CPCB’s centralized EPR portal. Manufacturers, importers, brand owners, and plastic waste processors must obtain a registration certificate for managing plastic waste. Without an EPR certificate, conducting business is prohibited by the CPCB.
