Required Documents for Individuals, Sole Proprietors, or Owners

Anyone can easily register a trademark in India, regardless of nationality. To register a trademark, one does not need to establish a corporate or legal body. Moreover, the documentation needed for registering a trademark under a sole proprietorship's name is identical to that needed to register the trademark within a person's name, and they are as follows:

• The person or lone proprietor's PAN card.
• The person or solo proprietor's AADHAR card.
• Description of products or services under a trademark.
• The POA form, -48.
• Cell phone no.
• The email address.
• The usage date.
• GST (if any): If a sole proprietorship or individual has registered for GST, it needs to be used.
• LOGO (if any); If a logo is present, mention it, with the exception of word mark registration for your brand.
• MSME, if any exist.
• BILLS, if any

Required Documentation for Limited Liability Partnerships (LLPs) and Companies - MSMEs

The following documents must be submitted in order for the partnership firm to register a trademark:

• KYC for each partner, including Aadhar and PAN cards, etc.
• GST (if any): The partnership firm must use the GST that it has taken out in its name.
• LOGO (if any): If a logo is present, mention it, with the exception of word mark registration.
• Trademark description: product or service description.
• The POA form, -48.
• Mobile no.
• Email address
• Usage date
• MSME, if any
• A deed of partnership
• BILLS, if any

Documents needed for limited liability partnerships, companies, and partnerships (apart from MSMEs)

The following documents are needed to register a trademark on the company's behalf:

• KYC of partners: this includes PAN cards, Aadhar cards, and other cards for each partner.
• GST (if any): If the business has registered for GST, it has to be used.
• LOGO (if any): If a logo is present, mention it, with the exception of word mark registration.
• Trademark description: product or service description.
• The POA form, - 48.
• Mobile no.
• Your email address.
• Date of usage.
• MSME, if any exist.
• The certificate of incorporation, or COI.
• Collections (if any).

Documents needed by MSMEs for Trusts, Societies, Statutory Bodies, and Others

Along with an Udyog Aadhar registration certificate, small businesses must have the following documents in order to register their trademarks:

1. A copy of your logo registration or trademark (optional) should be in JPG or PNG format, 8 by 8 cm in size, and should be either color or black and white. In the event that the logo is unavailable, the wordmark may also be utilized.
2. Form TM-48: This document gives a trademark agent or attorney permission to submit an application for trademarks on the applicant's behalf. The candidate must sign the document.
3. Certificate of Udyog Aadhaar Registration.
4. A record attesting to the organization's existence, like a brand registration certificate or trust deed.
5. Evidence of the authorized signatory's identity for the organization.
6. Provide evidence of the authorized signatory of the organization.

Documents needed for statutory bodies, trusts, societies, HUFs, and other entities

If an applicant does not have an Udyog Aadhar Certificate, they must submit the following documentation:

1. A copy of the trademark or logo registration (optional) should be in the JPEG or even PNG format, 8 by 8 cm, and should be in color as well black & white. If the logo registration isn't accessible, you can still use the wordmark.
2. Form TM-48: This document serves as the applicant's permission for a trademark agent or attorney to submit a trademark application on behalf of the applicant. The applicant must sign the form.
3. Evidence of the organization's existence, such as a trust deed, registration certificate, or other document.
4. evidence of the authorized signatory's identity for the organization.
5. Provide evidence of the authorized signatory of the organization.
6. A trademark opposition provision is present. Anybody may start trademark opposition procedures by filing a notice of trademark objection through the Trademark Journal along with sufficient supporting documentation, no later than four months after the application was first advertised or re-advertised.
