Consent To Operate And Consent To Establish

Delhi comes under the pollution control area. Hence, every industry is to take Consent To Establish and Consent To Operate from the DPCC. Otherwise, no one else is to establish or operate any industry in Delhi. This certificate shows that the industry will not harm the environment. If you wish to establish an industry that will discharge waste in the stream, well, sewer or land, then obtaining this certificate is mandatory.

Categorization by DPCC

White Category Industry

The Ministry of Environment, Forest and Climate Change (MoEFCC) introduced the White category in the year 2016. As these industries are considered non-polluting, so there is no need to ascertain consent certificates and environmental clearance from the government. The industries falling under this category are:
  • Bio-fertilizer
  • Pesticides
  • Electronic items
  • Baby carriages, etc.

DPCC Documents Checklist for Consent/NOC

The documents required for DPCC NOC/Consent to Operate/Consent to Establish are as follows:
  • PAN Card
  • Aadhar Card
  • Authorization letter
  • Municipal or industry license
  • Factory, trade or health trade license
  • In addition to this, the industry needs to submit proof of registration of the unit.
  • There needs to be an application form along with the registration fee.
  • The industry also needs to submit proof of registration of the unit.
  • FSSAI and GST certificate
  • Water Bill
  • Electricity bill
  • The proof of ownership
  • Undertaking

DPCC Document for DPCC Green, Orange, And Red Category (Consent To Establish)

For the industries falling under the Green, Orange and Red category, the following documents are necessary:
  • Application Form
  • Consent Fee
  • An undertaking by the applicant in the prescribed format.
  • A project report containing all the details about the unit, capital, and mandatory investment, number of workers, manufacturing procedure, products, etc.
  • A Layout plan
  • Possession of the plot proof. This could be the allotment letter, lease deed or valid rental agreement.
  • PAN card of the Proprietor/HCU/Industrial Unit.
  • An original letter of authorization is required except in the case of the individual proprietary concern.
  • In case the industry falls under the purview of the Master Plan of 2021, then the latitude and longitude dimensions shall be submitted in the self-certified undertaking.

DPCC Documents for Green Category (Consent To Operate/Renewal)

  • The applicant needs to submit the application form with the consent fee.
  • He/she should also submit the duly-signed undertaking in the prescribed format.
  • A certificate issued by the Chartered Accountant.
  • A Noise Monitoring Report issued by the laboratory of DPCC.
  • In the case of Common Effluent Treatment Plant, then the industry is to submit a proof of CETP membership. And it is done in the name & address of the unit.
  • A Copy of the power bill/electricity
  • PAN Card of the Industrial Unit/Proprietor/HCU
  • You also need to submit the original authorization letter except in matters of individual Mandatory proprietary concern
  • And if the industry falls under the category of mandatory re-development plan of 2021, then the details of latitude and longitude should be given in the undertaking.

DPCC Documents Checklist for Orange and Red Category for Consent To Operate or Renewal

  • The applicant needs to submit the application form with the consent fee.
  • He/she should also submit the duly-signed undertaking in the prescribed format.
  • A certificate issued by the Chartered Accountant.
  • A list of raw materials used, manufactured products and by-products.
  • In addition to this, it required the ETP(Effluent Treatment Plant)/STP (Sewage Treatment Plant) effluent analysis report
  • A Noise Monitoring Report issued by the laboratory of DPCC.
  • A Copy of the power bill/electricity
  • PAN Card of the Industrial Unit/Proprietor/HCU
  • You also need to submit the original authorization letter except in matters of individual Mandatory proprietary concern
  • And if the industry falls under the category of mandatory re-development plan of 2021, then the details of latitude and longitude should be given in the undertaking.
  • It is not mandatory though advised to submit a copy of CGWA (Central Ground Water Authority) or DJB (Delhi Jal Board) or DC (Deputy Commissioner) permission.
  • Certificate of registration for SSI (Small Scale Industries)/MSME (Micro-Small and Medium Enterprises)
  • In addition to this, the applicant is required to submit a proof of conformity with the master plan of Delhi from the concerned authority
  • If the business comes under the hotel industry (includes a restaurant, eating house, sweet shop, Dhaba and hotels, banquet halls and party lawns), then proof of the connection of the drainage system from the concerned department or a self-attested undertaking.
  • And if industry uses tobacco raw materials, then a license from the food safety department is a must
  • If it is a petrol pump, then approved layout plan, letter of approval from the oil company, allotment letter, and lastly proof of conformity with the master plan.

Some other key-points

 There are some important points that you need to take care of:
  1. First of all, the classification of industries in Delhi is done based on their capital and pollution potential.
  2. Second, of all, there is no need to acquire consent to establish and operate in the case of the white category. In such a case, there is a need to file an undertaking to DPCC. Every other industry needs to have both consent to establish and consent to operate as per the Air and Water Act.
  3. In addition to the mentioned above, a new notification dated 10th June 2019, white category industries need to register online along with the document checklist. So, for this, you need to pay a one-time fee of Rs.10,000.
  4. The validity of consent to establish is 1-7 years. The consent to operate for the red/orange and green category is 5 years and 10 years respectively.
  5. Another point to take note of is that DPCC takes around 90-120 days to decide an application for consent after the receipt of the application.
